Abstract

This thesis is focused on the area of mining law, namely the legal regulation of selected mining legal institutes related to environmental protection in mining activities. In the first chapter, respectively at the beginning of the thesis, the basic questions are set out within the scope of the subject matter, which besides the classical ambitions - thematically compile and sort out the available information, and also to assemble legal norms across the spectrum of the national legal order, from which the knowledge of the legal regulation of environmental protection in mining activities in a broader context than is traditionally lectured in mining studies. The main text of the thesis is divided into eight chapters, respecting the generally accepted direction of the process ranging from general to concrete, so that the areas follow one another logically. The first chapter presents the concept of up to date mining. The second chapter provides an explanation of the basic terms that are used throughout the bachelor thesis. The third chapter conveys the knowledge of legal theory that is decisive for a comprehensive understanding of mining law as a part of environmental law that creates a framework for mining legislation. This is followed by the fourth chapter, which analyses the constitutional principles of environmental protection in the realization of mining activities. The fifth chapter contains a brief explanation of selected legal means of environmental protection, in particular, zone planning, territorial decision making and environmental impact assessment, which are reflected in the mining permit procedure. The seventh chapter, which is then dominant not only in its scope but also in its significance, analyses the selected legal institutes, which are important from the point of view of environmental protection, for individual mining activities. The eighth chapter summarizes economic instruments of environmental protection in carrying out mining activities. It takes into account the duplication of the legal regime of environmental protection in mining. The thesis is closed with a conclusion, which summarizes the processed issues and their most important points.
