Volný pohyb zboží v judikatuře Soudního dvora Evropské unie

Abstract

Předmětem této diplomové práce je svoboda volného trhu zboží z pohledu evropského práva se zaměřením na judikaturní činnost Soudního dvora Evropské unie. Prostřednictvím vymezení právní úpravy volného pohybu zboží a rozhodovací činnosti Soudního dvora Evropské unie je zhodnoceno, jaký podíl má judikaturní činnost Soudního dvora Evropské unie na stanovení pravidel volného pohybu zboží a jaký má činnost Soudního dvora Evropské unie celkový vliv na svobodu volného pohybu zboží. První kapitola práce se soustředí na svobodu volného pohybu zboží a její problematiku obecně. Je představen její historický vývoj, hlavní charakteristiky, zásady fungování, překážky volného pohybu zboží a konečně jeho právní zakotvení v primárním a sekundárním právu. Druhá kapitola práce se věnuje instituci Soudního dvora Evropské unie a průběhu samotného řízení před Soudem v otázkách volného pohybu zboží, který je následně srovnán s průběhem řízení před obecným civilním soudem v České republice. Činnost soudu je dále statisticky analyzována a zhodnocena. Poslední kapitola podrobně vymezuje judikaturu v oblasti dovolených omezení volného pohybu zboží a předestírá postup rozhodování soudců, který dále demonstruje na konkrétním příkladu.

This diploma thesis deals with the freedom of free movement of goods in the perspective of European law focusing on the judicature of the Court of Justice of the European Union. The significance and overall influence of activities of the Court of Justice of the European Union have been assessed on basis of analysis of legislation and decision-making activities. The initial chapter of the thesis examines the freedom of free movement of goods and its issues from the general point of view. The historical development, main characteristics, principles of functioning, obstacles of free movement of goods and finally its stipulation in primary and secondary law are presented. The second chapter focuses on the authority of the Court of Justice of the European Union and the proceedings before the Court regarding matters of freedom of free movement of goods which is afterwards compared with the proceedings before general civil court in the Czech Republic. The activities of the Court are statistically analysed and assessed. The last chapter thoroughly describes particular decisions concerning allowed restrictions of free movement of goods and introduces the procedure of decision making put into praxis by judges which is further demonstrated on the specific case.
