Srovnání právní úpravy nekalé soutěže v České republice a v Německu

Abstract

The thesis deals with finding the defferences between two legislation, Czech and German. Then foccuses on the evaluation and proposes possible changes in one of these national legislation. The first part explains the basic terms such as economic competition, unfair competition, entities of unfair competition, facts of the case of unfair competition etc. The next part is discussed both of the legislaton as it evolved over the years to the present. This part served to compare them. Comparison of the two legislation was not performed only from a theoretical point of view but also in terms of practice. It was chosen several examples of unfair competition by Czech and German courts. The last part occurs to evaluate all the found differences in terms of European Union law. Contribution of this thesis is the proposal, how could the German legislation to enrich Czech law of unfair competition.
