Analýza jednotlivých spôsobov exekúcie využívaných v exekučnom riadení

Abstract

Bakalárska práca je zameraná na exekučné prostriedky, ktoré sú v súčasnosti využívané pri výkone exekúcie. Cieľom práce je určiť najefektívnejší spôsob a dôvody, ktoré vplývajú na využívanie týchto prostriedkov, a porovnať českú právnu úpravu spôsobov exekúcie so slovenskou. Teoretická časť popisuje hlavné termíny z oblasti exekúcie ako napr. osobu súdneho exekútora, Exekútorskú komoru a pod. Ďalej podrobne charakterizuje exekučné prostriedky pre peňažné aj nepeňažné plnenia. V rámci praktickej časti sú vyhodnotené štatistiky využívania exekučných prostriedkov a vybraný najefektívnejší spôsob. Následne boli metódou komparácie zistené najvýraznejšie rozdiely medzi skúmanými právnymi úpravami.

This bachelor thesis is focused on execution means being used when execution provided. The aim of the thesis is to define the most effective way and results impacting the usage of those means and compare Czech and Slovak legal regulation. Theoretical part describes the main terms out of execution field e.g. a person of court executor, Executor Chamber etc. Further there are execution´s means of settlement are considered as for finances or non-financial settlement. In the practical part there are statistics of executor means usage evaluated and the most effective way determined. By the comparison method the differences have been found out as for legal regulations.
