Ochrana proti nekalosoutěžnímu jednání

Abstract

This thesis deals with prevention of an unfair competition. My goal was to identify and describe particular means of prevention of an unfair competition and introduce wide legal regulations regarding an unfair competition to the reader. In addition, the thesis shows the close relationship between Economy and unfair competition and evaluates previous and current legal regulations of an unfair competition. First chapter deals with private legal and statutory regulations of an unfair competition. Second chapter shows the economical and legal consequences created by an unfair competition. The last chapter is practical and compares legal regulations of an unfair competiton according to the paragraph 140/1962 of the Collection of Law and the paragraph 40/2009. Based on this comparison, the thesis gives an advice for legislators how to make quality legal regulations in order to ensure the maximum fair-play in competing business.
