Analýza pracovní smlouvy a dohod o pracích konaných mimo pracovní poměr v podniku

Abstract

Labour-law relationship concluded between an employer and an employee is inseparable part of our lives. The aim of this bachelor thesis is to analyze employment contracts and agreements on work performed outside an employment relationship in the enterprise. In theoretical part, there are employment relationship determined and employment contract, contract for work and contract for services characterized. Labour-law relationships are compared and advantages and disadvantages resulting from them and relating to both employer and employee are discussed. In practical part, there is an analysis of labour-law relationships in concrete company provided as well as evaluation of legal aspects of employment contract and agreements on work performed outside an employment. Company documents have gone under investigation and it was found out that the said company follows all rules given by the law. The hypothesis has been proved that legal regulation of employment contract and agreements on work performed outside an employment is acceptable and understandable and that this company does not break any law.
