Způsoby řešení úpadku podle insolvenčního zákona, zákona č. 182/2006 sb.

Abstract

This thesis introduces ways of solving bankruptcy through the Act No. 182/2006 Coll. about bankruptcy and ways of its solution (insolvency law). The first part describes new legislation arrangement’s essential changes in comparison to an earlier arrangement, the Act No. 328/1991 Coll. about bankruptcy and settlement. The work describes inappropriate features of the previous arrangement and the reason which led a legislature to adopt an entirely new arrangement. It further explains the meaning of a term bankruptcy, how it may occur, and possible forms of its solution. Next part of the thesis in detail explains particular ways of resolving insolvency (bankruptcy, reorganization and debt relief) and their contributions to our society but also their certain risks. Finally there is summary of new changes made to the legislation arrangement, which are confronted with a practical experience that I gained by using the insolvency law in common routine.
