Právní bariéry vstupu do podnikání v ČR

Abstract

Tato diplomová práce se zaměřuje na právní bariéry vstupu do podnikání v ČR. V teoretické části práce dochází k rozdělení okruhů bariér na právní, ekonomické a osobní, a jejich následnému rozboru. Praktickou část tvoří kvalitativní výzkum v podobě polostrukturovaných rozhovorů s 5 podnikatelskými subjekty. Cílem práce je zjistit, zda právní bariéry patří mezi největší bariéry při vstupu do podnikání v ČR u vybraného vzorku podnikatelů. Výsledkem je nepotvrzení hypotézy, podle které "právní bariéry patří mezi 3 největší bariéry při vstupu do podnikání." Pro zkoumané subjekty představovaly největší bariéry osobní faktory. Vedlejším cílem práce bylo zjistit, jaký mají podnikatelé postoj k jednotlivým bariérám, a pochopit, proč tomu tak je. Během výzkumu také vyšlo najevo, že podnikatelé často nevědí, jaké mají povinnosti. V tomto ohledu autor doporučuje využít služeb Hospodářské Komory ČR v podobě Obecné příručky pro podnikatele nebo Právního elektronického systému.

This diploma thesis focuses on the topic of legal barriers to entry into business in the Czech Republic. In the theoretical part of the work, the barriers are divided into 3 branches – legal, economic, and personal barriers. That is followed by a subsequent analysis of each barrier. The practical part consists of qualitative research in the form of semi-structured interviews with 5 entrepreneurs. The aim of the work is to find out whether legal barriers are among the 3 biggest barriers to starting a business in the Czech Republic for a selected sample of entrepreneurs. The result is the disconfirmation of the hypothesis according to which "legal barriers are among the 3 biggest barriers to entry into business in the Czech Republic." The author found out that the biggest barriers for the investigated subjects were not from the legal branch, but rather from the personal one. A secondary goal of the work was to find out what attitude entrepreneurs have towards individual barriers and to understand the reasoning behind that. During the research it also became clear that the investigated entrepreneurs often do not know what their obligations are. In response to these observations, the author recommends using the services of the Czech Chamber of Commerce, such as the “General Handbook for Entrepreneurs” or the “Legal Electronic System”.
