Oddlužení manželů v praxi českých soudů

Abstract

Predmetom mojej bakalárskej práce je oddlženie manželov v praxi českých súdov. Vo svojej práci sa zaoberám rozborom a vymedzeným oddlženia za pomoci insolventného zákona. Upozorňujem na vznik a zánik spoločného majetku manželov a budem riešiť možné problémy medzi insolventným riadením a spoločným majetkom manželov. Ďalej som nahliadla najmä na problematiku, či je vôbec možné spoločné oddlženie manželov a určila som akým spôsobom sa rieši úpadok alebo hroziaci úpadok manželov. V závere svojej práci, upozorňujem na informácie ako postupovať pri oddlžení manželov v praxi.

The theme of my bachelor's thesis is discharge from debts of married couple in the Czech court practice. The analysis and the definition of discharge from debts with the help of insolvency law is dealt in my thesis. I call attention to the formation and the extinction of common property of married couple and will solve possible problems between the insolvency management and the common property of married couple. Besides I referred to an issue if there is ever the common discharge of married couple possible and determined how the decline or possible decline of married couple is solved. Finally I draw attention to the information how to proceed in discharge from debts of married couple in the practice.
