Vymezení soutěžního práva a analýza činností Úřadu pro ochranu hospodářské soutěže v dané oblasti

Abstract

The aim of this thesis was to analyze selected decisions and sanctions that were imposed on the Office for the Protection of Competition. In the theoretical part of this thesis a competition law, its history and development was described, then attention on the competition was paid on as well as the terms connected to it were explained and particular forms of competition were described. The next chapter deals with the Office for the Protection of Competition itself. Its competences, authority and duties are specified in detail. In the practical part of the thesis an analysis of decisions and sanctions was provided. Ten years period has been analyzed from 2002 to 2011. First of all the numbers of administrative proceedings and the number of effective decisions done out of each competition field by individual years were examined. Further, the significant cases having been dealt with by the Office for the Protection of Competition in recent years were stated. When analyzed the sanctions the highest sanctions imposed by OPC were examined as well as sanctions above 50 mil Czech Crowns including those, which came into force and which have been avoided by the courts. At the end total evaluation of the Office for the Protection of Competition was provided and some changes were recommended.
