Právní ochrana firmy

Abstract

Téma mé bakalářské práce je právní ochrana obchodní firmy. Zabývám se ochranou obchodní firmy jak fyzické, tak právnické osoby. Cílem mé bakalářské práce je objasnit ochranu obchodní firmy právnické a fyzické osoby v rámci platné legislativy v České republice a na základě získaných poznatků vyhodnotit, zdali je dostatečná nebo ne.

V první části vysvětluji pojmy spojené s ochranou obchodní firmou, podrobně se věnuji absolutní a relativní ochraně.

V druhé části práce objasňuji ochranu podle ochranných známek, chráněné označením původu, zeměpisné označení. Dále se zabývá ochranou dobré pověsti a názvu právnické osoby podle občanského zákoníku a ochranou fyzické osoby podle občanského zákoníku.

Poslední, třetí kapitola srovnává a vyhodnocuje ochranu obchodní firmy fyzické a právnické osoby.

This bachelor thesis deals with the Legal Protection of Trade Name. I focus on the protection both a personal entity and a legal entity. The aim of my bachelor thesis is to clarify the protection of a trade name of a legal and personal entity within the valid Czech legislation. On the basis of the gained knowledge I analyzed whether it is sufficient or not.

As for the first part, the thesis covers the explanation of trade name. I focus on the absolute and relative protection.

As far as the second part was concerned, the trade marks protection, protected designation of origin, geographical designation is explained. Further the protection of good reputation, the name of a legal entity and the protection of a personal entity according to the Civil Code is discussed.

In the last chapter the protection of the trade company is compared and analyzed from the point of view of the legal and personal entity.
