Abstract

Abstract This bachelor's thesis deals with position of creditors in the debt relief process. At first, I characterize the debt relief itself, the attitude of creditors, the possibilities of using debts in the insolvency proceedings and I analyze the satisfaction of debtors wit help repayment schedule. A very often problem of creditors' attitude in the debt relief process is the return of provided loan which was also the result of my analysis. The analysis was carried out on 120 persons. This amount was divided into two halves, where the first half contained the fulfilled debt relief for the period of five years (the year in which the debt relief began 2008-2010) and the second half contained the beginning process of debt relief (the year in which the debt relief began 2014). According to the analysis, the whole satisfaction rate of the creditors is about 54% (lowing potential) within the group of beginning debt relief process. The result of the analysis is not favourable to creditors. Debtors are often not forced by the insolvency law to increase their income and subsequently satisfy creditors. In accordance with the result I recommend setting up firm conditions for the process of debt relief e.g. setting up a higher minor boundaries for fulfilling the debt relief.
