Vymáhání pohledávek formou exekuce

Abstract

V úvodu předložené práce je zmíněno, že exekuce nebo výkon rozhodnutí je provázen exekučním řádem a občanským soudním řádem. Ve druhé části jsou uvedeny způsoby exekucí, kterými můžeme podle současné legislativy pohledávky vymáhat. Ve třetí části je vysvětlen průběh exekuce s praktickými příklady na exekuce prodejem podniků, a to v oblasti nerostných surovin a v oblasti nákladní dopravy. V následující části jsou vyhodnoceny statistické údaje navržených a skončených exekucí a vyhodnocení exekucí v různých závislostech. Na závěr práce je zařazeno doporučení všem budoucím oprávněným, aby vymáhání pohledávky neodkládali a snažili se zahájit exekuční řízení co nejdříve prostřednictvím exekutora.

In the introduction of the submitted work it is mentioned, that execution or performance of the decision is accompanied by the execution code and civil legal code. In the second part the methods of execution are introduced, with which we can claim the debts according to present legislation. In the third part the course of the execution is explained with practical examples of executions by selling of the businesses, such in the area of the mineral resources and in the area of the freight. In the next part the stats are evaluated of the nominated and finished executions and the evaluation of the executions in different dependence. In the end of the work recommendation for the future competent people are placed not to postpone the estreat of the debt and to try to begin the execution procedure as soon as possible by way of the executive.
