Ekonomické a právní aspekty kartelových dohod a jejich postihování

Abstract

This work deals with the legislation of cartel agreements and their prosecution. The aim of this study is to asses the opportunities of prosecution of cartel agreements and of economic competition protection. The first part is dedicated to terms from the field of competition law and to cartel agreements from legal point of view. Cartel agreements from economic point of view and and economic aims of competition law are analyzed in the second part. Third part is dedicated to violation of competition law prosecution from the point of view of administration law nad criminal law. There are also research of public knowledge of cartel agreements, assesment of legislation in the field of economic competition protection and improvement suggestions. Methods of analysis, synthesis, questionnaire research and comparison are used in this work. The work shows that the main aim of legislation in the field of economic competition is to maintain effective economic competition while the interventions in behaviour of companies stay minimal. The emphasis should be put on prevention and alternative ways of solving competition problems.
