Porušení povinností účastníků pojistné smlouvy a návrhy na jejich řešení

Abstract

This thesis is focused on the violation of participants obligations in the insurance contract. The main aim is to point out the differences in resolutions according to insurance law and according to insurance conditions. Thesis is divided into two parts. Theoretical part of the thesis characterizes basic terms and essentials of insurance contract, division of insurance products and insurance rate calculations. Afterwards there are described legal violations of obligations chronologically, as well as the ones from insurance conditions of 3 selected insurance companies. In the practical part there are 5 examples of violations of the obligations as well as suggestions of their solutions. Each example highlights differences in solution according to law and insurance conditions. At the end of each solution there are economic impacts and terms mentioned.
