Právní aspekty pojistné smlouvy

Abstract

Diplomová práce je zpracována na téma právní aspekty pojistné smlouvy.

Prioritním cílem této diplomové práce je zjištění orientace spotřebitelů v základních pojmech pojistného práva, nové právní úpravě a v pojistných podmínkách, které hrají podstatnou roli při uzavírání pojistné smlouvy. A také prezentace odlišností současné právní úpravy zákonem č. 37/2004 Sb., o pojistné smlouvě a budoucí právní úpravy pojistné smlouvy zákonem č. 89/2012 Sb., občanský zákoník. Ke zjištění těchto cílů jsou použity tyto metody vědecké práce: dotazování, srovnání, analytickou klasifikaci a experiment.

Diplomová práce je členěna do pěti kapitol, přičemž první je úvodní. Ve druhé kapitole, která nese název právní úprava pojistné smlouvy, budou popsány zákony, jež upravují tuto problematiku. Existuje zde takzvaný trojí právní režim v úpravě pojistné smlouvy. Třetí kapitola se nazývá proces uzavírání pojistné smlouvy. Čtvrtá kapitola je zaměřena na formulaci vybraných pojistných podmínek, na dotazníkové šetření a ověření pravdivosti stanovených hypotéz. A v poslední páté kapitole zjistím, zda byl naplněn cíl mé diplomové práce, provedu závěrečné shrnutí a případné doporučení.

This thesis is elaborated on the legal aspects of insurance contracts.

The primary objective of this thesis is to determine the orientation of consumers in terms of; basic insurance law, new legislation and policy conditions. That play a significant role in the conclusion of the insurance contract. The presentation also shows differences of current legislation by Act No. 37/2004 Coll., The insurance policy and future insurance contract law Act No. 89/2012 Coll., The Civil Code. To determine these objectives, these methods of scientific work are used to: interviewing, comparison, analysis classification and experiment.

The thesis is divided into five diffirent chapters, the first chapter is introductory. The second chapter, which bears the name of the insurance contract law. Are described laws that regulate this issue. There is a so-called triple the legal regime in the organization of the insurance contract. The third chapter is the process of concluding the insurance contract. The fourth chapter focuses on the formulation of selected insurance terms, to survey and ascertain the accuracy of the hypotheses. And in the final chapter I find the objective of my thesis, conduct a final summary and possible recommendations.
