Mediace jako alternativní způsob řešení sporů

Abstract

The diploma thesis talks about mediation as an alternative way for disputes solving and its use. The paper is separated in two basic chapters. The first part characterizes medations from theoretical point of view. Explenation of a mediation, a characteristic of chosen methods, which characterise all ways as negotiations, concilations, arbitration proceedings, mini-trial, medi-arb, mediations, exeprtize and online arbitraiton proceedings, subsequently theoretical, economic and legal advantage with focus on mediation term. Subject of mediation, explanations of term mediator and what are his roles and understandings. The paper describes process of mediation, medial deals and what are aspects in Czech republic with a focus on Asocications of mediators of Czech republic, Unite for judge and mediation drive of Czech republic and other institutes. In the second part is talked about real-world examples for detail image of how the mediation works in practice. The end contents a final summary.
