Abstract

This thesis deals with changes in the Executory Code. It focuses on the Amendment No. 286/2009 Sb. In my work I give attention to the flaws in the legal status of the debtor and to the flaws in the acts of the executor, which have not been removed in the Amendment. The first chapter deals with general changes in the Executory Code since its beginnings to the present. I also point to the direction of future development of enforcement proceedings. In the second chapter, I compare the executor's actions in enforcement proceedings before and after the Amendment. The final chapter focuses on the legal status of a debtor in the present and how it is affected by the Amendment.
