Sociální právo Evropské unie

Abstract

Diplomová práce řeší problematiku sociálních práv Evropské unie, jako prvek novodobé evropské demokracie. Dále charakterizuje oblast pracovního práva Evropské unie, jeho vývoj a především jeho prameny obsahující směrnice, které mají dopad na každého občana Evropské unie. Praktická část práce se zaměřuje na sociální zabezpečení Evropské unie, jeho dnešní podobu a vliv na systémy sociálního zabezpečení v jednotlivých členských státech. První část práce s názvem „Pojetí sociálního práva Evropské unie“ vymezuje vývoj sociálních práv od jeho počátku až do dnešních dnů. Dále nám představuje znaky, prameny a právní vztahy v sociálním právu. V závěru této části je rozebrán přístup k sociálním právům a jejich vymáhání. Druhá část práce „Pracovní právo Evropské unie“ se zaměřuje na funkce pracovního práva, orgány tvořící a napomáhající dodržování pracovních práv v Evropské unii. V praktické části budou charakterizovány některá pracovní práva sekundární povahy, která mají dopad na všechny evropské občany společně s uvedením výsledků jejich dodržování napříč Evropskou unií. Třetí část práce se nazývá „ Právo sociálního zabezpečení Evropské unie“ a zaobírá se především novým koordinačním nařízením, které má největší vliv v oblasti sociálního zabezpečení. Poslední část práce se soustředí na dávky sociálního zabezpečení, zvláště potom na dávky ve stáří a dávky pozůstalých.

Ústředním cílem této práce je charakteristika a zhodnocení problematiky sociálních práv evropského konceptu a pohled na jejich vývoj. Dílčím cílem práce je analyzovat systém sociálního zabezpečení, který je pozměňován dle vývoje Evropské unie.

The thesis deals with the problems of social laws of the European Union as an element of the modern European democracy. Furthermore it characterizes the domain of labor law of the European Union, its development and mainly its sources including directives which have an impact on every citizen of the European Union. The practical part of the thesis is focused on the social security of the European Union, its contemporary form and the influence on social security systems in the individual member states.

The first part of the thesis called ‘The Conception of Social Law of the European Union’ defines the development of the social laws from the beginning up to the present days. Further it introduces the traits, sources and legal relations in the social law. In the end of this part the approach to the social laws and their requisition are analyzed.

The second part ‘Labor Law of the European Union’ is aimed on the functions of the labor law, the bodies which help respecting labor laws in the European Union. In the practical part some secondary labor laws which have impact on all European citizens are characterized and the results demonstrating observance of these labor laws across the European Union are given.

The third part which is called ‘Social Security Law of the European Union’ mainly deals with the new coordination regulation which has the largest impact on the social security field. The last part of the thesis is focused on the social security benefits, especially old age benefits and the survivors’ pensions.

The central purpose of this thesis is to characterize and evaluate the problems concerning social laws of the European conception and the view of their development. The partial aim of this thesis is to analyze the social security system which is varied according to the development of the European Union.
