Ekonomické a právní aspekty systému ochrany průmyslového vlastnictví

Abstract

Cílem této práce je shrnout obecný právní základ problematiky ochrany průmyslových práv v České republice a její provázanost s evropskou a mezinárodní ochranou. Dále pak poukázat na protiprávní jednání v oblasti průmyslových práv, a to od méně závažného, až po nejzávažnější jednání, trestnou činnost, zejména pak trestné činy podle § 268 a § 269 trestního zákoníku. V práci jsou rovněž shrnuty statistické výstupy uvedené trestné činnosti v České republice v letech 2013-2017, způsoby odhalování těchto trestných činu, škoda způsobena touto trestnou činností a její rozložení v rámci České republiky. Nechybí ani obecný popis způsobu odhalovaní této trestné činnosti a návrhy, které by mohly vést ke zlepšení dané problematiky.

The main aim of the thesis is to sum up a common legal base of the economic rights protection in the Czech Republic and its connection with the European and international protection. The next point is to focus upon the illegal action in the frame of economical rights, including all forms of the action, up to the most nuisance effect, criminal action, especially the crimes according to § 268 and § 269 o the Criminal Code of the Czech Republic. The thesis also deals with the statistical data regarding this kind of criminal activity in the Czech Republic in the years 2013-2017. Also, the detection methods and damages caused by this criminal activity are mentioned in the thesis, such as common description of the detection methods, and the ideas and measures that might lead to successful improvement in the stated area of interest.
