Pojistné podvody při pojišťování motorových vozidel a jejich odhalování

Abstract

Diplomová práce se zabývá pácháním pojistných podvodů v oblasti pojištění motorových vozidel s dílčím zaměřením na systémy využívané k odhalování podvodů včetně dopadů tohoto podvodného jednání. Cílem diplomové práce je zhodnocení způsobů páchání a metod odhalování pojistných podvodů v oblasti pojištění motorových vozidel a analýza dopadů pojistných podvodů na zúčastněné subjekty. Teoretická část práce je věnována především vymezení základních pojmů jako je podvod, konkrétně pak pojistný podvod a následně pojmů týkajících se pojistné smlouvy a jednotlivých účastníků tohoto závazkového vztahu. Dále je zde podrobně rozebrané pojištění motorových vozidel, a to ve dvou základních formách. Zákonné, tedy povinné pojištění, pojištění odpovědnosti z provozu vozidla a dobrovolné smluvní pojištění, havarijní pojištění. V praktické části je velký prostor věnovaný především konkrétním způsobům, jimiž jsou pojistné podvody na motorových vozidlech páchány, včetně nejčastějších příkladů z praxe, s nimiž se lze setkat. Zároveň jsou v této části podrobně rozebrány jednotlivé systémy a metody, které značně pojišťovnám napomáhají při detekci pojistných podvodů. V neposlední řadě jsou zde přiblíženy důsledky tohoto podvodného jednání jak pro pojišťovny, tak pro samotné pachatele či poctivé klienty pojišťoven.

The diploma thesis deals with the committing of insurance fraud in the field of motor insurance with a partial focus on the systems used to detect fraud, including the effects of this fraud. The aim of the diploma thesis is to evaluate the methods of committing and methods of detecting insurance fraud in the field of motor insurance and to analyze the impact of insurance fraud on parties involved. The theoretical part of the thesis is mainly devoted to the definition of basic terms such as fraud, specifically insurance fraud and then the terms relating to the insurance contract and the individual participants in this contractual relationship. Furthermore, there is a detailed analysis of motor insurance provided in two basic forms. Statutory, i.e. compulsory insurance, motor third party liability insurance and voluntary contractual insurance, accident insurance. In the practical part, a large space is devoted mainly to the specific ways in which insurance fraud is committed on motor vehicles, including the most common examples from practice that can be encountered. At the same time, this section discusses in detail the individual systems and methods that greatly assist insurance companies in detecting insurance fraud. Last but not least, the consequences of this fraud for both insurance companies and the perpetrators themselves or honest clients of insurance companies are described.
