Abstract

The aim of this thesis is to achieve a synthesis represented by insolvency law as a single and comprehensive part of the Czech legal code by continual analysis of development, process and legal regulation; to determine progressive tendencies of the number of insolvency proceedings since 2008. In the first part historical context, rules and subjects participated in the process are defined; the main focus is stressed on creditors and their authorities. The further part deals with economical aspects of insolvency proceedings, by which coming crisis in the company can be revealed. Process of insolvency proceedings is analyzed in detail from its beginning to issuing the decision of bankruptcy, or its solution. There is also process of debts submission analyzed as well as the properties being converted into money as the result of bankruptcy. The next chapter considers individual ways of bankruptcy solution – bankruptcy and reorganization. last chapter analyzes statistical tendencies of insolvency proceedings as for both aspects, proceedings duration and individual ways of solution. This thesis serves to those who consider submitting the insolvency proposal and want to know about the whole process. It can also help the companies to reveal coming crisis.
