Public Private Partnership v podmínkách obcí České republiky

Abstract

Předmětem diplomové práce byla problematika Public Private Partnership uplatňována v podmínkách obcí České republiky. Cílem diplomové práce bylo na základě identifikace silných a slabých stránek Public Private Partnership projektů realizovaných na úrovni obcí za období let 2005 až 2012 vymezit faktory ovlivňující jejich uplatnění a rozvoj v podmínkách obcí České republiky. K dosažení stanoveného cíle byla diplomová práce strukturována do pěti kapitol, z nichž první je úvod a poslední je závěr. Druhá kapitola pojednává o významných formách alokace veřejných zdrojů, s níž je financování investic na úrovni obce spojeno. Jednou z forem, jak financovat investice na úrovni obce je forma Public Private Partnership, kterou vymezuje třetí kapitola diplomové práce. Čtvrtá kapitola vymezuje objekty analýzy, kterými jsou obce České republiky za sledované období let 2005 až 2012, vedené v databázi Asociace PPP, která monitoruje Public Private Partnership projekty, členěné podle oblasti investice, velikosti obce, stavu realizace Public Private Partnership projektů a krajů České republiky, dotazníkové šetření a analýzu jeho výsledků a strukturální analýzu vybraného Public Private Partnership projektu. Jedním z faktorů je časová náročnost Public Private Partnership projektů. Public Private Partnership projekty jsou charakteristické jejich uzavíráním na velmi dlouhé období, ale volební období starosty resp. zastupitelstva je čtyřleté. Jiný starosta by mohl projekt zabrzdit. Musí existovat politická shoda. Dalším faktorem je transparentnost projektu a perspektivní vymezení cílů a očekávání z partnerství. Public Private Partnership projekty jsou uzavírány na velmi dlouhé období a je nesnadné predikovat přínos z projektu. Dlouhé období realizace Public Private Partnership projektu klade nároky na komplexnost a rozsáhlost smlouvy, která mnohdy bývá několik stovek stran, proto také náklady na právního poradce jsou obvykle velmi vysoké a takto rozsáhlé smlouvy se také vyznačují neflexibilností a mnohdy až přehnanou složitostí požadované dokumentace.

The subject of the thesis was the issue of Public Private Partnership application in the municipalities of the Czech Republic. The aim of this thesis was based on the identification of the strengths and weaknesses of Public Private Partnership projects at the municipal level for the period 2005-2012 to define the factors influencing their use and development in conditions of municipalities of the Czech Republic. To achieve the objectives of the thesis is structured into five chapters, the first of which is the introduction and the last is the conclusion. The second chapter discusses the major forms of allocation of public resources with which to finance investments linked to the municipal level. One of the ways to finance investments on the municipal level is a form of Public Private Partnership, which defines the third chapter of the thesis. The fourth chapter defines the object of analysis, which are the municipalities of the Czech Republic during the reporting period 2005-2012, kept in a database PPP Association, which monitors the Public Private Partnership projects, broken down by area of investment, size of the municipality, the implementation of Public Private Partnership projects and the regions of the Czech Republic, survey and analysis of the results of a structural analysis of a Public Private Partnership project. One factor is the length of Public Private Partnership projects. Public Private Partnership projects are characterized by their entering into the very long term, but term mayor respectively. Assembly is four years. Another mayor could slow down the project. There must be political consensus. Another factor is the transparency of the project perspective and definition of the objectives and expectations of the partnership. Public Private Partnership projects are concluded for a very long period and it is difficult to predict benefit from the project. Long term implementation of Public Private Partnership project puts demands on the complexity and size of contracts, which often is several hundred pages, therefore the cost of legal counsel are usually very high and thus extensive contracts are also characterized not flexible and often exaggerated the complexity of the required documentation.
