Negativní aspekty podnikání ohrožující vztahy mezi subjekty hospodářské činnosti

Abstract

V předložené práci je zpracováno téma záměrně vyvolaných negativních zásahů do podnikatelských subjektů ze strany třetích osob, resp. problematiku hospodářské kriminality. Prvotní zaměření je na motivaci pachatelů a charakteristiku podmínek umožňujících její páchání. Práce dále vymezuje nejčastější protiprávní delikty tohoto typu a stručně charakterizuje běžné formy hospodářské kriminality, blížeji rozebírá formy páchání na úseku daní, finančního a kapitálové trhu, rovněž tak problematiku úpadkových trestných činů. Další tematický okruh pak se pak zaměřuje na zjištění a dokumentaci takového jednání v trestním řízení, předkládá způsoby získávání informací a označuje subjekty, které mohou sloužit jako jejich zdroj. Poslední část práce ukazuje na aktuální nedostatky a neefektivnosti ve stádiích trestního řízení vedených policejními orgány a předkládá možné návrhy na jejich řešení.

This submitted work theme treats of negative entenferences with business subjects intentionally developed by third party, or more precisely issue of economic crime. Primary focus is on the motivation of the perpetrators and characteristics of conditions for its perpetration. The work further defines most common offences of this type of illegal and briefly describes common types of economic crime, closer examines forms of committing in the field of taxation, financial and capital market, as well as the issue of decadent offenses. The next thematical scope is then focused on detection and documentation of such conduct in criminal proceedings, presents the procedure for obtaining information and indicates the entities that can serve as their source. The last part of the work shows the current shortcomings and inefficiency in the stages of criminal proceedings conducted by police authorities and submits suggestions for possible solutions.
