Formy řešení úpadku z právního a ekonomického hlediska

Abstract

Bakalářská práce je zaměřena na problematiku úpadku a způsobů jeho řešení dle InsZ. Insolvenční zákon je účinný od 1. 1. 2008. Poslední jeho novelizace v roce 2009 byla vyvolána reakcí na ekonomickou krizi. InsZ přináší nové způsoby řešení úpadku, zrychlení insolvenčního řízení, posílení pozice věřitelů. Práce popisuje úpadek a jednotlivé formy jeho řešení. Konkurz, reorganizace a oddlužení jsou následně zhodnoceny z pohledu věřitele a dlužníka. V závěru práce jsou porovnávány statistické údaje s uvedenými způsoby řešení úpadku za rok 2008 a 2009.

Bachelor's thesis is focused on bankruptcy and forms of bankruptcy solution by InsZ. Insolvency law is effective from 1. 1. 2008. Its last revision in 2009 was caused by a reaction to the economic crisis. InsZ brings new forms of bankruptcy solution, the acceleration of the insolvency proceedings, strengthen the position of creditors. This work describes the bankruptcy and forms of bankruptcy solution. Bankruptcy, reorganization and debt relief are then evaluated from the perspective of the creditor and debtor. In conclusion, there are statistics compared with those forms of bankruptcy solution in 2008 and 2009.
