Mimosoudní řešení spotřebitelských sporů

Abstract

Hlavním cílem diplomové práce je uvést čtenáře do problematiky mimosoudního řešení spotřebitelských sporů se zaměřením na Českou republiku. Teoretická část práce je zaměřena na vymezení klíčových pojmů z oblasti spotřebitelského práva, jež se k dané problematice vztahují jako ochrana spotřebitele, spotřebitelská smlouva, spotřebitelský spor a další. Prakticko-aplikační část je naopak zaměřena na zhodnocení efektivity stávající praxe jakož i na zhodnocení informovanosti spotřebitelů v dané problematice včetně jejich postojů. Pro dosažení tohoto cíle došlo k využití statistické analýzy a dotazníkového šetření.

The main objective of the thesis is to introduce the reader to the issue of out-of-court settlement of consumer disputes with a focus on the Czech Republic. The theoretical part of the thesis is focused on defining key concepts from the field of consumer law that are related to the given issue, such as consumer protection, consumer contract, consumer dispute and others. The practical part, on the other hand, is focused on evaluating the effectiveness of current practice as well as on evaluating the awareness of consumers on the given issue, including their attitudes. To achieve this goal, statistical analysis and a questionnaire survey were used.
