Abstract

Title of my Diploma thesis is „Execution – Method of Overdue Account Recovery" with the aim to characterize a court executor/bailiff and his/her actions, definition of enforcement procedure and methods of execution performance. First part describes characteristics of a bailiff, including the criteria and conditions how to become a bailiff, explaining what is independency, what is the function of the Chamber of Bailiffs of the Czech Republic, what members it associates and what the rights of Ministry of Justice are. I further focused on the enforced executions of Enforcement Orders with the description of individual criteria and conditions for launching of enforcement, such as process conditions, participants of the procedure, enforcement order, property right claim and enforceability. The enforcement itself is described in second part of the thesis, from bailiff selection, through execution order and costs up to the stay, lifting and termination of execution. Synergy of third parties supporting the bailiff in acquiring information about the obligor is quite important sub-point. International collection and recovery is also mentioned for the sake of interest. Third part provides analyses of individual methods of enforcement procedure followed by the detailed description of the whole enforcement process in real life.
