Úpadok fyzických osôb so zameraním na spoločné oddlženie manželov

Abstract

This diploma thesis is focused on bankruptcy of physical persons with focus on deleveraging husbands debt and on the amendment of insolvency act. After short historical excursion the author deals with debts of the Czech families and then there is insolvency procedure described related to joint property of spouses. Further, there is the whole process of discharge from debts gone into. Concluding chapters use model situation, the solution of which as for discharge from debts is compared from the point of view of the previous as well as of current legislation. Positive impact of new legislation on husbands facing bankruptcy is pointed out. The last part of the thesis the author analyses those different types of solutions of this problem.
