Abstract
This diploma thesis deals with the analysis of patent protection at the European Union level. The main aim is to provide comprehensive overview of current European patent protection and future unitary patent protection at the European Union level and based on the findings to clarify possible impacts of the introduction of unitary patent protection in the Czech Republic.
The theoretical part of the thesis defines the sources of European patent law and characterizes the European Patent Office together with the European patent application. Other parts of the thesis are a key point, because they define the legal framework of unitary patent protection. The theoretical part is supplemented by practical knowledge according to the current situation.
In the practical part of the thesis, an analysis of the legal and economic impacts of the introduction of unitary patent protection in the Czech Republic was provided. The comparison of the Agreement on the Unified Patent Court with the constitutional order of the Czech Republic is another important section in the practical part of the thesis.
In the conclusion, the results show that a number of legislative changes will be necessary, even at the level of constitutional laws. From the economic point of view, unitary patent protection will affect the state budget and will have different effects on large companies and small and medium-sized enterprises.
