Zánik závazku v obchodním vztahu

Abstract

This bachelor thesis focuses not only on the historical meaning of legislation regulating extinction of obligation in accordance with Roman Law but also describes particular ways of extinction of obligation in civil and commercial legal relations as they are regulated by valid legislation. Substantial part of the thesis describes problems of extinction of obligation in commercial relation by discharge of obligation; another chapter of the thesis analyses other ways of extinction of obligation in commercial relations. The closing part of the thesis brings information on the contents of some decisions of the Supreme Court of the Czech Republic concerning these problems, since in many cases of commercial relations the opinion on the extinction of obligation is not unambiguous. These decisions of the Supreme Court of the Czech Republic might also be a guideline for solving disputes between the contractual parties, or they even might prevent their emergence.
