Blankosměnka jako zajišťovací instrument

Abstract

This bachelor thesis deals with blank bill of exchange as securing instrument in a bank practice. Comparison of blank bills of exchange and master agreements on fulfilling law provided by banks of the Czech Republic is the issue of the thesis. The aim of the thesis is to identify risks connected to the use of those bills and to propose such measures, which would eliminate those risks. In the theoretical part of the thesis, there is a legal regulation of bills, relations, types and functions of bills described. Securing function of the bill and characteristics connected with this function are described in more detail. Further, the thesis is focused on blank bill of exchange – its basis, marks, creation and termination of bill fulfilling law. Bill of exchange agreement on fulfilling law as it comes to its content and participants is also described in the thesis. Pros and cons of bills are mentioned being compared with other types of securing means. In the practical part of the thesis, master bills and agreements are compared being provided with by the banks operating in the Czech Republic. Agreements on fulfilling law designed by this thesis author are the part of the thesis as well. Those could become optimal for both debtor and creditor.
