Abstract

Abstract Mediation as a Method of Dispute Resolution Bc. Barbora Pagáčová The aim of my thesis is to describe the essence of mediation as a method of dispute resolution. The aim is to demonstrate the possibility of widespread application of mediation in dispute resolution and confirm the hypothesis that a key element in the success of mediation is a mediator, his characteristics, abilities and skills. The theoretical part is divided into two sections. In the first one is a description of a conflict, its structure and basic styles of conflict management. There is also a characteristic of dispute resolution infront the court and through arbitration. In the following theoretical section are found ADR methods including the mediation and her objective and purpose, principles, requirements for a mediator and his tools, the phase of the mediation process, the expansion of mediation services in the Czech Republic and the use of mediation in practice. In the practical part I will try to achieve the goal by showing examples of mediation processes that deal with conflicts in family affairs, political sphere, environmental areas, peer and community conflicts.
