Abstract
The theme of the diploma thesis is discharge of debts for natural persons under insolvency act. This diploma thesis is divided into five chapters. The first chapter contains an introduction. The second chapter is devoted to basic concepts – insolvency act, bankruptcy, ways of solving bankruptcy, insolvency proceedings and insolvency register. This chapter also deals with subjects of the insolvency proceedings. The third chapter contains a detailed analysis of the institute of discharge of debts. In the practical part of the diploma thesis I deal with a fictional natural person in a bancruptcy. In this thesis debtor´s assumptions for discharge of debts, court´s decision on the authorization and approval discharge of debts, course of discharge of debts including numerical calculations and the result of this debtor´s discharge of debts are presented. In the practical part there is also a proposal for debt discharge permission drawn up. In the fourth chapter I analyse the evolution of discharge of debts in the Czech republic since 2008. The last chapter is the conclusion. The main aim of this thesis is to describe in detail the institute of discharge of debts, especially conditions of discharge of debts, filing proposal for debt discharge permission and insolvency proposal, forms discharge of debts and the course of insolvency proceedings. This thesis shows that the discharge of debts can be useful for the debtor and its main advantage lies in the debtor´s chance to ask an insolvency court for relief from the rest of the outstanding debts.
