Trestné činy a správní delikty na úseku životního prostředí

Abstract

ANOTACE DIPLOMOVÉ PRÁCE V předložené práci se zabývám problematikou právní ochrany životního prostředí z pohledu trestního práva a správního práva. V úvodní části je obecně hodnocen význam životního prostředí pro lidstvo a jeho budoucnost. V oblasti trestního práva je zpracována analýza stávajících trestných činů na úseku ochrany životního prostředí a porovnána s příslušným ustanovením v rekodifikovaném trestním zákoně, který je v době zpracování práce již platný, ale účinný od 1. ledna 2010. V oblasti správního práva je zpracovávána problematika přestupků a jiných správních deliktů právnických a fyzických osob při výkonu podnikatelské činnosti, vztahující se k právní ochraně základních složek životního prostředí. V závěru práce je věnována pozornost některým problémovým otázkám v této oblasti a nástin možných řešení z pohledu právního vědomí „de lege ferenda“.

ANNOTATION OF DIPLOMA THESIS The thesis deals with the issue of legal protection of the environment. It is ensured mainly by the criminal and administrative law. In the intoriduction the importance of the environment for humans and their future is generally assessed. In the area of the criminal law is included the analysis of recent crimes in the environmental protection area and it is compared with particular clauses in recodified criminal law, which is already valid in present time, but it is going to be at force from January 1st 2010. In the area of administrative law there are generated the penal offences and administrative torts for individuals and corporations issue during their business activity, which is connected with the legal protection of the constituent parts of the environment. In the end of this work the emphasis is focused on some problematic questions in the field of possible solutions from the “de lege ferenda” point of view.
