Abstract

The concern of this thesis is confronting the theoretical concept of Islamic bank products with the current practice while, at the same time, providing a critical analysis of this practice from the viewpoint of the basis of the Islamic finance law. The concern of this thesis is confronting the theoretical concept of Islamic bank products with the current practice while, at the same time, providing a critical analysis of this practice from the viewpoint of the basis of the Islamic finance law. The results acquired by this research are then confronted with the possibility of Islamic finance functioning in Europe in terms of legal feasibility and economic efficiency. As indicated by the adjective "Islamic", the issue of this work is inseparably linker with the Islamic faith. Therefore I paid great attention to Islamic law, with emphasis on capturing his overall philosophy. Specific features of Islamic economic and finance are described too with underscores their fundamental principles. For comparison I select products operating on the principle of sharing profits and losses - Mudaraba and Musaraka. They are the best representative of Islamic finance. With those two, I choose Murabaha too, which is works - compared to the above - on overhead rates principle. This work also analyzes the very principle of sharing profits and losses in the view its pros and cons. In the case of Murabaha are investigated the disputes about its legality in the Islamic legal framework. In the final chapter the compatibility of the principles of Islamic finance in European, especially Czech, law systems are examined. The main focus is aimed on the possibility of the Bank's operations and offering their products. Reflection on the potential of the principles of Islamic finance offer answers to the problems of conventional banking are also presented in the final part.
