Soudní vymáhání pohledávek po splatnosti z pohledu exekučního řízení

Abstract

The Bachelor’s Thesis, Judicial Debt Recovery after Maturity from the Perspective of Execution Procedures, deals with the issue, which is actual, and thus with the enforcement of due receivables through the judicial executor. Until 2001, the claims of the creditors were enforced in the Czech Republic only through the court. The fundamental turning point in the executive proceedings meant the adoption of the Act No. 120/2001 Coll., on Judicial Executors and Executory Activities in 2001, by which the institute of judicial executor was established. This person has an estates status. The requirements put on this person are stipulated by the law, which says that he is a private-law subject that is not rewarded by the state but has competences delegated from the state in order to secure receivables enforcement. This Bachelor’s Thesis gives an insight on this institute of the judicial executor, including the whole system, the way this institute is administered, and further focuses on the particular instruments and means, which the judicial executor has at his disposal for the effective, reliable and fast receivables enforcement. Last but not least this thesis contains a great deal of practical examples.
