Soudní vymáhání pohledávek po splatnosti z pohledu exekučního řízení

Abstract

Bakalářská práce na téma Soudní vymáhání pohledávek po splatnosti z pohledu exekučního řízení se zabývá problematikou, která je aktuální a to je vymáhání dlužných pohledávek prostřednictvím soudního exekutora. Do roku 2001 se v České republice vymáhaly nároky věřitelů pouze prostřednictvím soudu. K zásadnímu zlomu v exekučním řízení pak došlo v roce 2001, kdy byl přijat zákon č. 120/2001 Sb. o soudních exekutorech a exekuční činnosti, kterým byl ustanoven institut soudního exekutora, což je osoba, která má stavovské postavení. Požadavky kladené na tuto osobu jsou stanoveny zákonem, s tím, že se jedná o soukromoprávní subjekt, který není honorován státem, avšak jsou na něj státem delegována oprávnění pro to, aby mohl zabezpečit vymáhání pohledávek. Zpracovaná bakalářská práce předkládá náhled na tento institut soudní exekutora, včetně celého systému, jak je spravován tento institut a dále se zaobírá jednotlivými nástroji a prostředky, které má soudní exekutor k dispozici pro účinné, spolehlivé a rychlé vymáhání pohledávek. V neposlední řadě tato práce obsahuje řadu praktických příkladů.

The Bachelor’s Thesis, Judicial Debt Recovery after Maturity from the Perspective of Execution Procedures, deals with the issue, which is actual, and thus with the enforcement of due receivables through the judicial executor. Until 2001, the claims of the creditors were enforced in the Czech Republic only through the court. The fundamental turning point in the executive proceedings meant the adoption of the Act No. 120/2001 Coll., on Judicial Executors and Executory Activities in 2001, by which the institute of judicial executor was established. This person has an estates status. The requirements put on this person are stipulated by the law, which says that he is a private-law subject that is not rewarded by the state but has competences delegated from the state in order to secure receivables enforcement. This Bachelor’s Thesis gives an insight on this institute of the judicial executor, including the whole system, the way this institute is administered, and further focuses on the particular instruments and means, which the judicial executor has at his disposal for the effective, reliable and fast receivables enforcement. Last but not least this thesis contains a great deal of practical examples.
