Abstract

The bachelor thesis is focused on the difficulties of the Building Act. The aim of the thesis is to introduce the basic concepts of building law, to shed light on the most common causes of disputes in construction, to create a detailed look at the changes being planned in the building law, and to recommend possible improvements in building law. The theoretical part defines the most commonly used concepts of the construction practice. Furthermore, the sources on which construction law is based and legal disputes that are common in construction practice are described. Then, arbitration is introduced as a suitable alternative to resolving construction disputes. The practical part analyzes the proposed amendment to the Building Act. The most significant reforms sought by the amendment are changes in the system of building authorities and in spatial planning. Efforts to digitize, shorten building permits, simplify document requirements for builders, and change in the form of judicial review should also have a major impact on the construction practice. In the conclusion, the results of the analysis are summarized, an overall evaluation, and a comparison of the amendment with the current legislation of the Building Act is presented. Based on the results, recommendations are formulated for another appropriate change in construction law.
