Úskalí stavebního zákona

Abstract

Bakalářská práce je zaměřena na úskalí stavebního zákona. Cílem práce je představit základní pojmy stavebního práva, osvětlit nejčastější příčiny vzniku sporů ve stavebnictví, vytvořit podrobný pohled na změny připravované ve stavebním zákoně a doporučit možné zlepšení stavebního práva. V teoretické části jsou vymezeny nejpoužívanější pojmy stavební praxe. Dále jsou popsány prameny, ze kterých stavební právo vychází a právní spory, které jsou ve stavební praxi časté. Pak je představeno rozhodčí řízení, jako vhodná alternativa k řešení stavebních sporů. V praktické části je analyzována navrhovaná novela stavebního zákona. Nejvýraznějšími reformami, o které se novela snaží, jsou změny v soustavě stavebních úřadů a v územním plánování. Velký vliv na stavební praxi by měla mít i snaha o digitalizaci, zkrácení povolování staveb, zjednodušení nároků na podklady za strany stavebníků a změna ve formě soudního přezkumu. V závěru práce jsou shrnuty výsledky analýzy, je provedeno celkové zhodnocení a srovnání novely se současnou právní úpravou stavebního zákona. Na základě výsledků jsou formulována doporučení na další vhodnou změnu stavebního práva.

The bachelor thesis is focused on the difficulties of the Building Act. The aim of the thesis is to introduce the basic concepts of building law, to shed light on the most common causes of disputes in construction, to create a detailed look at the changes being planned in the building law, and to recommend possible improvements in building law. The theoretical part defines the most commonly used concepts of the construction practice. Furthermore, the sources on which construction law is based and legal disputes that are common in construction practice are described. Then, arbitration is introduced as a suitable alternative to resolving construction disputes. The practical part analyzes the proposed amendment to the Building Act. The most significant reforms sought by the amendment are changes in the system of building authorities and in spatial planning. Efforts to digitize, shorten building permits, simplify document requirements for builders, and change in the form of judicial review should also have a major impact on the construction practice. In the conclusion, the results of the analysis are summarized, an overall evaluation, and a comparison of the amendment with the current legislation of the Building Act is presented. Based on the results, recommendations are formulated for another appropriate change in construction law.
