Odpovědnost zaměstnance za škodu a její náhrada v praxi

Abstract

The main goal of this paper is to capture the essential characteristics of employee`s liability for damages, what employer must demonstrate to prove the employee`s liability for damage, and was thus entitled to compensation, from the theoretical point of view and sample representation of the individual conflicts between an employee and the employer of the judgments court. The theoretical part is divided into two chapters. The first is focused on explaining the problem of legal liability and labor - law liability, there is also explained the concept of damage. Second theoretical part describes different types of liability. Main part, is part of the fourth, which shows the individual judgments of the courts by type of liability. Here there is a problem of conflict, meet the prerequisites for the creation of liability, legal proceedings and ultimately position the Supreme Court of the Czech Republic. I will try to achieve the objectives of the work through the differences and causes, what employer have to prove, if he wanna to be successful in applying his claims, and when the are not successful
