Státní dozor v oblasti ochrany spotřebitele

Abstract

Tématem bakalářské práce je státní dozor v oblasti ochrany spotřebitele. Cílem této práce je analýza procesu kontroly vykonávané Českou obchodní inspekcí, a to konkrétně vyhodnocení důležitosti těchto kontrol ve vztahu k ochraně spotřebitele na vnitřním trhu. V první, teoretické části jsou uvedeny základní pojmy a vymezena právní úprava a institucionální zajištění ochrany spotřebitele. Druhá část je věnována podrobnější analýze procesu kontroly se zaměřením na práva a povinnosti kontrolních pracovníků. Popsány jsou také nápravné prostředky navazující na výkon kontroly. V další kapitole jsou vyhodnoceny výsledky kontrol a provedeno zamyšlení nad vybranými tématy týkající se oblasti zprostředkování uzavírání smluv na dodávky energií, odběrů vzorků a institutu ukládání příkazů na místě. V této části je také provedeno zhodnocení činnosti České obchodní inspekce v oblasti ochrany spotřebitele na základě komparace statistických dat, přičemž je konstatováno, že samotná existence právních předpisů upravujících práva a povinnosti subjektů ve spotřebitelských vztazích nezajistí v plné míře jejich dodržování, proto je účelné, aby Česká obchodní inspekce v těchto kontrolách i nadále pokračovala.

The topic of this thesis is the state supervision in the field of consumer protection. The aim of this thesis is to analyze the process of inspection carried out by the Czech Trade Inspection Authority. Namely to evaluate the importance of these inspections in relation to consumer protection on the Czech market. First, in the theoretical part, the basic terms and the legal regulations and institutional arrangements for consumer protection are defined. The second part is devoted to a more detailed analysis of the inspection process, focusing on the rights and obligations of the inspectors. The corrective remedies following the performance of control are also described. The third part evaluates the results of inspections and reflects on the selected topics related to the mediation of the conclusion of contracts for the supply of energy, sampling and the issuance of the on-the-spot fines. This part also evaluates the activities of the Czech Trade Inspection Authority in the area of consumer protection based on the comparison of statistical data. It is stated that the very existence of legal framework regulating the rights and obligations of entities in consumer relations will not ensure their full compliance. Therefore it is expedient, that The Czech Trade Inspection Authority continues in these inspections.
