Abstract
The thesis focuses on the issuing activity of Czech national bank and its legislation. The aim of my work was to evaluate the activities of the issuing activity of Czech national bank, focusing on administrative and organizational tools. In my work I deal with economic and legal definition of money, its historical development, importance of the central bank in relation to the monetary circulation. More specifically, after the Czech National Bank. The practical part is concerned mainly organizational administrative tools of Czech National Bank which this bank use to no problem pay in cash and cashless payment system and contribute to the protection of the currency and care for it.CNB has the exclusive right of law in our country to issue cash money. Cashless money can issue other banks. This fact can cause problems for regulation to monetary circulation, accelerates the circulation and can lead to disruption of monetary equilibrium. Similar to the electronic money even to maintain its position in the economy being constructed. The starting point for legislative standards throughout the area of monetary law. All powers CNB as monopoly issuer of cash money are regulated in § 12 - § 22 of Law No. 6 / 1993 Coll. CNB. Practical activities are then regulated by the rules or official advise by the CNB. The law issued by the CNB are about denominations of banknotes and coins, their size, materials and other essentials, indicating cash in circulation, take cash out circulation. In cash circulation exist activities which poses a problem for it. The most famous is the counterfeit banknote and coins. The situation of counterfeit in the Czech Republic is stable. Cash circulation rules also respond to the safety of non-cash transactions in relation to the fight against organized crime and terrorism. Since 2004 payment in cash is limited by law for payments above € 15,000. Cashless money form in Czech republic 6/7 of total money supply in circulation and therefore most payment using cashless payments.From the macroeconomic point of view is cashless payments are more significant than the cash circulation. Nevertheless, the first cashless payment system to comprehensively regulated by the year 2003. As at 5 June 2010 entry into force of the revised law on payments. To protect the currency and the care it provides CNB since 1993 accountable cashless payments by billing CERTIS which handles interbank payments denominated in czech currency. Since 2003 it is possible to solve disputes between clients and banks and issuers of electronic money out of court by the financial arbiter. The financial arbitrator is authorized to resolve disputes only the amount of 50,000 euros within its competence as misuse of credit cards in shops. The growing influence of cashless payments in the future we can expect deepening this area and new laws in the issuance and use of electronic money.
