dc.description.abstractIm vorliegenden Beitrag wird das Vorhandensein von Überregulierungen innerhalb präskriptiver Anforderungen durch bauordnungsrechtliche Vorschriften und durch Forderungen innerhalb von Genehmigungsverfahren untersucht. Das brandschutztechnische Sicherheitskonzept von Gebäuden wird durch materielle Anforderungen unter Berücksichtigung von Schutzzielen mit bauordnungsrechtlichen Vorgaben bundeslandabhängig festgelegt. Daneben werden Forderungen an den Brandschutz auch innerhalb von Genehmigungsverfahren gestellt. In dieser Untersuchung erfolgt die Identifizierung von Überregulierung mittels deskriptiver Statistik, statistischer Inferenz und qualitativer Inhaltsanalyse basierend auf einer Umfrageerhebung. Die materiellen Anforderungen können dabei weitestgehend nicht als überreguliert bestätigt werden. Vielmehr besteht ein generelles Empfinden zur Überregulierung in Bezug auf die materiellen Anforderungen und in Genehmigungsverfahren, welches sich in bestimmten materiellen Anforderungsbereichen und Gebäudetypen widerspiegelt und dabei in Abhängigkeit der Prüfinstitution steht.
dc.description.abstract-enThis paper analyzes the existence of overregulation within prescriptive requirements by building regulations and by requirements within approval procedures. The fire safety concept of buildings is determined by material requirements taking into account protection goals with building regulations depending on the federal state. In addition, fire protection requirements are also set within approval procedures. In this study, descriptive statistics, statistical inference, and qualitative content analysis based on a survey are used to identify overregulation. In general, the material requirements cannot be confirmed as overregulated. Rather, there is a general perception of overregulation regarding material requirements and in approval procedures, which is reflected in certain material requirement areas and building types as well as it is dependent on the inspection institution.
